$375,000 SETTLEMENT BY GORDON MCKERNAN & MCKERNAN LAW FIRM FOR CEMENT TRUCK ACCIDENT

May 2, 2011. Baton Rouge, Louisiana. A 59-year old man, the plaintiff, was in his vehicle at a complete stop when he was struck by a cement truck traveling in reverse on Worthy Road in Ascension Parish. The plaintiff injured his lumbar spine and underwent conservative care as a result of the accident. The plaintiff received a lumbar fusion approximately two years post-accident. The defendants contested causation citing that the plaintiff had gone to his family doctor two weeks before the accident and complained of back pain radiating into his legs. The plaintiff rebutted with the fact that the accident greatly increased his symptoms and led to him needing surgery. The case was settled for $375,000 shortly before the trial.
