Louisiana Laws on Texting & Cell Phone Use While Driving

64 plus car wreck settlements

Texting and driving has legal consequences in Louisiana. The first time a driver is caught committing this offense, he or she is subject to a $500 fine. Any offense after this is punishable by a $1000 fine and license suspension for 60 days.

Drivers under the age of 18 can also face penalties for texting while driving. First-time offenders can be fined $250, and following offenses can be fined up to $500 with a 60-day license suspension.

Fines for all ages are doubled if a car accident took place while the driver was texting.

It is dangerous and illegal to text while driving. Drivers may use the calling function of their phones in the event of an emergency, but this should still be done with caution. Using a phone in any capacity while operating a vehicle is distracting and can have serious consequences.

Texting and Driving Car Accident Statistics

All drivers should be well aware of the laws against texting while driving. Ignoring such laws can cause wrecks, death, or other losses. The following statistics show just how harmful texting and driving can be.
Car Wreck Attorney

  • Distracted driving claimed 2,841 lives in 2018, including passengers, pedestrians, and drivers. [1]
  • More than 1,000 people are injured every day due to a distracted driver.
  • Sending or reading a text takes your eyes off the road for an average of 5 seconds. [2]
  • At 55 mph, texting while driving is like driving the length of an entire football field with your eyes closed. [2]
  • For children, youth, and young adults aged 8–24, motor vehicle crashes are the primary cause of death, with teens having the highest proportion of distraction-related fatalities. [3]

Texting While Driving is as Dangerous as Driving Drunk

Drivers who talk on the phone are four times as likely to get in a car wreck than drivers who are fully focused on the road. Additionally, people who text while driving have a reaction time similar to drunk drivers with a blood alcohol content (BAC) of .08%. This distracted driving can cause fatal accidents on the road.
