The plaintiff, a Labor Finders employee was traveling in Calcasieu Parish on LA Highway 370 when an uninsured motorist crossed the center-line and hit his vehicle head on. The plaintiff was knocked unconscious and suffered a heal fracture, lumbar and cervical strains, and contusions as a result of the accident. The plaintiff accumulated $25,000 in medical expenses. Suit was filed against his employer’s auto insurer citing that UM coverage was not properly rejected and sought for coverage under the policy. Coverage was granted under the employer’s policy, but the UM carrier received a credit for all of the medical expenses and lost wages paid by Worker’s Compensation. After mediation failed the case settle for $300,000.
