Louisiana Laws on Texting & Cell Phone Use While Driving

64 plus car wreck settlements

Louisiana law prohibits texting while driving. Offenders can receive up to $500 in fines after the first violation and up to $1000 for any following transgressions. Additionally, a 60-day suspension of a person’s license may be set in place if he is caught texting while operating a vehicle more than once.

Underaged drivers can also receive up to $250 in fines for this violation of the law. The following offenses are subject to up to $500 fines and a suspension of license for 60 days.

Fines for both adults and minor drivers are doubled if a car accident took place while texting and driving.

Talking on the phone should be limited when driving. Texting while driving should not be done at all. Doing so can cause devastating accidents.

Texting and Driving Car Accident Statistics

Texting while driving endangers both drivers and anyone else on the road. It can result in car accidents, fatalities, or other losses. The following statistics show just how dangerous this practice can be.
Car Wreck Attorney

  • Distracted driving claimed 2,841 lives in 2018, including passengers, pedestrians, and drivers. [1]
  • More than 1,000 people are injured every day due to a distracted driver.
  • Sending or reading a text takes your eyes off the road for an average of 5 seconds. [2]
  • At 55 mph, texting while driving is like driving the length of an entire football field with your eyes closed. [2]
  • For children, youth, and young adults aged 8–24, motor vehicle crashes are the primary cause of death, with teens having the highest proportion of distraction-related fatalities. [3]

Texting While Driving is as Dangerous as Driving Drunk

Drivers who talk on the phone while driving are four times as likely to get in a car wreck. When drivers text while operating their vehicles, this likelihood is increased. Reaction time for texting while driving is similar to driving with a blood alcohol content (BAC) of .08%. Both types of distracted driving are dangerous, but texting and driving is measurably worse.
