Louisiana’s 51% Fault Rule and What It Means for Riders

Louisiana changed how shared blame works, and riders feel that change harder than anyone.

Under Louisiana Civil Code Article 2323, as amended by Act 15 of 2025 and effective January 1, 2026, a person who is 51% or more at fault recovers nothing at all. A person found less than 51% at fault can still recover, with the award reduced by their share.

That one change rewrote the adjuster’s playbook. Under the old rule, pushing a rider’s fault higher only shaved the payout. Now, pushing you past 51% erases it. Expect them to try, and expect the helmet question and the speed question to be part of how they do it.

Which version of the rule governs your crash can depend on when it happened. Sorting that out is one of the first things we do, and it is a good reason to call before you give anyone a statement.

Helmet and Lane Laws Insurers Use Against Riders

Two Louisiana statutes surface in nearly every motorcycle claim, and adjusters lean on both.

Louisiana Revised Statutes 32:190 requires anyone operating or riding a motorcycle to wear a properly secured safety helmet, and Louisiana has kept that requirement on the books.

Louisiana Revised Statutes 32:191.1 governs lane use. Subsection C bars operating a motorcycle between lanes of traffic or between adjacent lines or rows of vehicles. Most riders know that part. Fewer know the first part of the same statute.

Subsection A says motorcycles are entitled to full use of a lane, and that no motor vehicle may be driven in a manner that deprives a motorcycle of that full lane. That rule is a tool, not a trap. When a driver crowds you out of your own lane, the statute stands with you.

Breaking one of these rules does not end your claim by itself. Fault still gets divided under Article 2323, and recovery is barred only once your share reaches 51%. The fight is over percentages, and we come prepared for it.

What Happens If You Were Riding Uninsured

This is the rule that catches the most riders off guard, and it recently got far harsher.

Under Louisiana Revised Statutes 32:866, as amended by Act 16 of 2025, an owner or operator who fails to own or maintain the required liability security cannot recover the first $100,000 of bodily injury damages or the first $100,000 of property damage. The previous thresholds were $15,000 and $25,000. Buying a policy after the crash does not undo the bar.

The statute does carry exceptions. That limit does not apply when the other driver is cited for DWI as a result of the crash and is convicted or pleads no contest, causes the crash intentionally, flees the scene, or is acting in furtherance of a felony. Passengers get their own protection under the statute as well, unless the passenger owns the uninsured motorcycle.

It also helps to know how little coverage the other driver may carry. Louisiana Revised Statutes 32:900 sets the required limits at $15,000 per person, $30,000 per crash, and $25,000 for property damage. Serious motorcycle injuries pass those numbers quickly, which is why locating every available policy matters so much.

How Long You Have to File in Louisiana

Louisiana calls its filing deadline a prescriptive period. Under Louisiana Civil Code Article 3493.1, delictual actions carry a liberative prescription of two years, and the clock starts the day the injury or damage is sustained. That article took effect July 1, 2024.

Two years sounds generous. It is not. Skid marks wash away, traffic and business camera footage gets overwritten on a loop, and witnesses move without leaving a number.
