Louisiana Speeding Accident Laws That Affect Your Claim
Two Louisiana laws changed recently, and both can affect what your claim is worth.
How Long You Have to File
Louisiana Civil Code article 3493.1 generally provides a two-year prescriptive period for delictual actions, beginning when the injury or damage is sustained. The rule applies prospectively to delictual actions arising after July 1, 2024, so the date and circumstances of your crash can affect which deadline applies.
Two years sounds like plenty. It is not. Camera systems record over old footage, vehicles get scrapped, and witnesses move away.
The New 51% Fault Rule
This is the change most people have not heard about. As of January 1, 2026, Louisiana no longer follows pure comparative fault.
Under Louisiana Civil Code article 2323, as amended by Act 15 of the 2025 Regular Session:
- If you are found less than 51% at fault, you can still recover, with your damages reduced by your share of the blame.
- If you are found 51% or more at fault, you recover nothing.
One percentage point can decide your entire case, which gives insurers a powerful reason to pile blame onto you. Which version of the rule applies can depend on the date of your crash, because Louisiana applies substantive law changes going forward only unless the legislature says otherwise (La. Civ. Code art. 6). We sort that out for you.
Insurance Minimums and the No Pay, No Play Law
Louisiana requires drivers to carry at least $15,000 per person and $30,000 per accident for bodily injury, plus $25,000 for property damage (La. R.S. 32:900). Those limits run out fast in a high-speed crash.
State law also limits recovery for people who were driving without required coverage. Under La. R.S. 32:866, an uninsured owner or operator cannot recover the first $100,000 of bodily injury damages or the first $100,000 of property damage. The statute lists exceptions, including crashes where the other driver was convicted of DWI, fled the scene, or caused the wreck intentionally.
