Statute of Limitations (Prescriptive Period)

• Accidents before July 1, 2024: One year from the date of the accident to file your claim
• Accidents on or after July 1, 2024: Two years from the date of the accident to file your claim

This change came from Act 423 (House Bill 315), signed into law in 2024.

Comparative Fault

As of January 1, 2026, Louisiana follows a modified comparative fault system. You can still recover compensation if you were partially at fault, but only if your share of the blame is 50% or less. If you are found 51% or more at fault, you are barred from recovering any damages at all.
