What Counts as Distracted Driving in Louisiana?

Most people picture a phone, and phones are a huge part of it. State safety officials define the problem more broadly than that.

Louisiana groups driver distraction into three types:

Visual distraction, when a driver takes their eyes off the road
Manual distraction, when a driver takes their hands off the wheel
Cognitive distraction, when a driver’s mind is somewhere other than driving

Louisiana’s Hands-Free Law Changed Distracted Driving Cases

Louisiana law restricts certain uses of wireless telecommunications devices while operating a motor vehicle. The specific restrictions and exceptions are defined by Louisiana law. La. R.S. 32:59, replaced the older texting ban.

Under the law, a driver cannot hold a phone, talk on it, read or send messages, check social media, watch video, or type anything while the vehicle is moving. Hands-free calling and mounted GPS navigation are still allowed.

Two parts of this law matter a great deal to your claim.

First, when a driver breaks the hands-free rule and causes a crash, the fine doubles. Second, the officer investigating that crash must write on the accident report that the driver was using a wireless device at the time.

Louisiana Laws That Affect Your Distracted Driving Claim

Three recent changes shape almost every New Orleans crash claim right now.

How Long You Have to File

Louisiana Civil Code article 3493.1 gives you two years from the date you were injured to file suit. That two-year window applies to injuries sustained on or after July 1, 2024. For older injuries, the previous one-year deadline still controls.

How Shared Fault Works Now

Louisiana used to let injured people recover something even when they were mostly to blame. That ended on January 1, 2026.

Under the current version of Civil Code article 2323, if you are found 51% or more at fault, you recover nothing. Below 51%, your award drops by your share of the blame. Crashes before January 1, 2026 still follow the older rule. Louisiana’s comparative fault rules determine whether and how an injured person’s recovery may be reduced based on their percentage of fault. The applicable rule depends on the date of the crash and current Louisiana law.

Insurance Limits and the No Pay, No Play Rule

Louisiana drivers must carry at least $15,000 per person and $30,000 per crash in bodily injury coverage, plus $25,000 in property damage coverage, under La. R.S. 32:900. Serious injuries blow past those limits fast.

If you were driving without insurance when the crash happened, Louisiana’s No Pay, No Play law may limit recovery for certain uninsured motorists, but exceptions can apply depending on the circumstances of the crash.
