Louisiana Laws That Affect Your Rollover Claim

Louisiana changed several rules that decide what injury victims recover. A few of them changed very recently. Here is what applies right now.

Deadline to File

Louisiana Civil Code article 3493.1 generally provides a two-year prescriptive period for delictual actions, beginning when the injury or damage is sustained. The rule applies to qualifying claims arising after July 1, 2024, so the date and circumstances of an accident can affect the deadline that applies.

Fault Sharing and the 51% Bar

La. Civ. Code art. 2323 was amended by Acts 2025, No. 15, effective January 1, 2026. If your share of fault is less than 51%, you can still recover, reduced by your percentage. If your share reaches 51% or more, you recover nothing.

Louisiana used to let people recover no matter how much of the blame they carried. That is no longer true. Because fault can affect the amount a claimant may recover, insurers may closely examine whether the injured person contributed to the accident.

Minimum Insurance in Louisiana

La. R.S. 32:900(B)(2) sets the required limits at $15,000 for bodily injury to one person, $30,000 per accident, and $25,000 for property damage. Those minimum limits may be insufficient to cover the losses associated with a serious rollover injury, making it important to identify all potentially available insurance coverage. Larger commercial vehicles carry higher required limits, which is one reason identifying every responsible party matters.

The “No Pay, No Play” Rule

La. R.S. 32:866 bars an uninsured owner or operator from recovering the first $100,000 in bodily injury damages and the first $100,000 in property damage, even when someone else caused the crash. Acts 2025, No. 16 raised those figures sharply.

The statute does list exceptions. Louisiana law provides several exceptions to this limitation, including certain crashes involving an intoxicated driver, intentional conduct, or a driver who fled the scene.
