Fighting for Lane Splitting Accident Victims Across Louisiana
Rush hour traffic crawls along I-10 in Baton Rouge. A rider eases between two rows of cars, and a driver swings into the gap without checking a mirror. In a heartbeat, the rider is on the pavement with a broken leg, a wrecked bike, and a lot of questions.
Lane splitting means riding a motorcycle between lanes of slow or stopped traffic. It’s against the law in Louisiana. But a traffic violation doesn’t automatically erase your right to compensation, especially when a careless driver helped cause the crash. A lane splitting accident lawyer in Louisiana can help sort out who’s really to blame.
Some riders weren’t splitting lanes at all. After a crash, drivers and insurers sometimes claim a rider was “between lanes” to shift the blame. We dig into the facts so a label doesn’t decide your case.
At Gordon McKernan Injury Attorneys, we stand up for injured riders across the state. Our motorcycle crash attorneys in Louisiana know insurers often call riders reckless the moment lane splitting comes up. We answer with evidence, not assumptions.
We’ve recovered $3 Billion for Louisiana families, including 230+ Million dollar verdicts and settlements. You pay nothing upfront, and there’s no fee unless we win.
Types of Motorcycle Lane Splitting Accident Injuries Our Louisiana Lawyers Handle
A rider caught between two vehicles can be hit from both sides at once. Mirrors, door edges, and bumpers can strike the legs, hips, and arms first. If the rider goes down, the pavement and nearby cars can cause even more harm.
Some injuries show up right away. Others, like some concussion symptoms, may not appear for hours or days. That’s why a full medical exam matters, even if you feel okay at the scene.
Here are some of the injuries we see most often:
Louisiana Lane Splitting Statistics
These numbers show how little room for error a rider has on the road. A motorcycle collision lawyer in Louisiana can use the facts of your crash to push back when an insurer blames you for everything. Each year, the National Highway Traffic Safety Administration (NHTSA) reports on motorcycle crashes nationwide. Here’s what its latest report found for 2024:
6,228
motorcyclists were killed nationwide, 16% of all U.S. traffic deaths
~86,887
motorcyclists were injured nationwide
3,396
deadly crashes involved a motorcycle and one other vehicle
Compensation You May Be Entitled To
Lane-splitting accident claims in Louisiana can cover much more than a damaged bike. If another driver’s carelessness helped cause your crash, we fight for the full value of your losses, including:
- Medical bills, past and future
- Surgery, rehab, and physical therapy
- Lost wages while you recover
- Reduced earning ability if you can’t return to your job
- Pain, suffering, and emotional distress
- Scarring or permanent impairment
- Loss of enjoyment of life
- Repair or replacement of your motorcycle, helmet, and gear
- Exemplary (punitive) damages in limited cases, such as a crash caused by a drunk driver
If you share some of the blame, your award may be reduced. As long as you’re less than 51% at fault, you can still recover. We look at your future needs, not just today’s bills, so a quick check doesn’t leave you short.
Not sure what your claim is worth? The personal injury team at Gordon McKernan can review your losses and help you understand your options.
How Louisiana Lane Splitting Accident Lawyers Handle Your Case
From your first call, Gordon McKernan Injury Attorneys handles the heavy lifting so you can focus on healing. Your consultation is free, and we’ll explain your options in plain language. When you hire our lane splitting accident attorneys in Louisiana, we move fast to:
- Get the crash report and check how it describes each vehicle’s lane position
- Find dashcam, traffic camera, business, and doorbell video before it’s erased
- Talk to witnesses who saw the lane change, door, or swerve
- Photograph and preserve your motorcycle, helmet, and riding gear
- Measure the scene, including lane widths and where each vehicle stopped
- Bring in crash reconstruction experts when your case needs them
- Gather your medical records and bills
- Find every insurance policy that may apply, including your own
- Handle all calls with insurance adjusters
- Prepare for trial if a fair offer never comes
Scrapes, dents, and paint transfer on your bike can show where the impact came from. Video can show a driver moving over without looking. That proof can shift the blame back where it belongs.
Many of these crashes start with a careless lane change, the same mistake behind many car wrecks. Our Louisiana car accident lawyers deal with these insurers every day, and we bring that experience to your motorcycle claim.
Mistakes to Avoid After a Lane Splitting Accident in Louisiana
A few missteps after a crash can weaken your claim. Avoid these common errors:
- Not calling the police to the scene
- Admitting fault or arguing with the other driver
- Guessing about speeds or distances while you’re shaken up
- Skipping the ER or urgent care because you feel okay
- Leaving without witness names and phone numbers
- Repairing your bike or tossing damaged gear before it’s documented
- Giving a recorded statement to the other driver’s insurer
- Posting about the crash or your riding on social media
- Taking a quick settlement before you know the full extent of your injuries
- Waiting too long to file your claim
Already made one of these mistakes? Don’t panic. Call us, and we’ll get to work protecting your claim.
Common Legal Challenges After a Lane Splitting Accident in Louisiana
Lane splitting claims often turn into a blame game. Injured riders and passengers may face:
- Insurers claiming the crash was 100% your fault because lane splitting is illegal
- Accusations of lane splitting when you were riding in your own lane
- Police reports that guess at lane positions or speeds
- Drivers who say they never saw you
- Disputes over how fast traffic was moving
- Passenger claims involving more than one at-fault driver
- Uninsured, underinsured, or hit and run drivers
- Lowball offers or flat denials
These roadblocks are stressful, but you don’t have to face them alone. With 679+ years of combined legal experience, our motorcycle lane accident lawyers in Louisiana know how to build a strong case and push back.

Understanding Louisiana Lane Splitting Accident Laws
Louisiana law is clear on lane splitting. Under La. R.S. 32:191.1, no one may ride a motorcycle between lanes of traffic or between rows of vehicles. That includes squeezing between stopped cars at a red light, often called lane filtering. Riders also can’t pass a vehicle inside that vehicle’s own lane.
The same law protects riders, too. Every motorcycle is entitled to the full use of a lane, and drivers may not crowd a rider out of it. Two motorcycles may ride side by side in a single lane, but no more than two. Drivers must also make sure a lane change is safe before they move over.
Lane splitting can lead to a traffic ticket. Still, breaking a traffic rule doesn’t automatically end your injury claim. A motorcycle lane splitting lawyer in Louisiana looks at what every driver did, not just you.
Statute Of Limitations:
Louisiana calls the filing deadline the “prescriptive period.” If you miss it, you could lose your right to recover.
- 2 years to file if your injury happened on or after July 1, 2024
- Injuries before that date fell under the older 1-year deadline
- Some claims follow different timing rules, so call us as soon as you can
Comparative Fault:
Since January 1, 2026, Louisiana follows a modified comparative fault rule. If you’re less than 51% at fault, your award is reduced by your share of the blame. At 51% or more, you can’t recover damages. Crashes before 2026 may be handled differently, so let us review your dates and facts.
Here’s how that can play out. Say you’re found 30% at fault for splitting lanes and the driver is found 70% at fault for an unsafe lane change. You could still recover 70% of your damages.
Minimum Insurance Requirements:
For motorcycle and other vehicle crashes, Louisiana requires drivers to carry at least:
- $15,000 bodily injury per person
- $30,000 bodily injury per accident
- $25,000 property damage
These limits can run out fast after surgery and months of therapy. Uninsured/underinsured motorist (UM) coverage may help fill the gap, so we review your own policies too.
Louisiana’s “No Pay, No Play” law also matters. If you didn’t carry required liability insurance, you may be barred from recovering the first $100,000 of injury damages and the first $100,000 of property damage. Exceptions apply, such as when the at-fault driver flees the scene or causes the crash on purpose.
