Types of Rollover Crash Accident Injuries
Rollover injuries can range from bruises and cuts to harm that lasts a lifetime. NHTSA has noted that in a rollover, everyone inside, even people wearing seat belts, can suffer head or neck injuries.
Louisiana Rollover Car Accident Statistics
Federal safety officials say a rollover is one of the most dangerous crashes a passenger vehicle can have. Here is what the National Highway Traffic Safety Administration (NHTSA) found for 2024:
28%
of passenger vehicle occupant deaths in the U.S. happened in rollover crashes
6,250
people nationwide died in passenger vehicles that rolled over
39%
of pickup occupant deaths and 32% of SUV occupant deaths happened in rollovers, compared with 20% for passenger cars
Louisiana Laws That Affect Rollover Accident Claims
When to File Legal Action in Your Rollover Case
Louisiana calls its filing deadline the “prescriptive period.” If you miss it, you can lose your right to recover.
- Injury claims from crashes after July 1, 2024: 2 years from the day of the injury (Civil Code Article 3493.1)
- Uninsured motorist claims: 2 years from the date of the crash (R.S. 9:5629)
- Wrongful death claims: 1 year from the death or 2 years from the day of the injury, whichever is longer (Civil Code Article 2315.2)
The two-year clock does not run against minors with a permanent disability in product liability cases (Civil Code Article 3493.1). Crashes on or before July 1, 2024 may fall under older rules. Call us, and we will review your timeline.
How a Rollover Happens
Rollover cases often raise different questions than many other Louisiana car accident cases. Federal safety officials describe two kinds of rollovers.
Tripped Rollovers
Most rollovers are “tripped.” The vehicle leaves the road and strikes something like a curb, a soft shoulder, or a guardrail, and it tips over. A driver who runs you off the road can start that chain of events.
Untripped Rollovers
A small share of rollovers are “untripped.” Nothing trips the vehicle. The grip between the tires and the road can tip it during a sharp swerve. These crashes raise hard questions about the vehicle’s design and its tires.
Why SUVs and Pickups Face Higher Risk
NHTSA has found that tall, narrow vehicles like SUVs are more likely than lower, wider cars to trip and roll once they leave the road. Its 5-Star Safety Ratings include a rollover rating that measures how top-heavy a vehicle is. An SUV rollover accident lawyer in Louisiana should study the vehicle as closely as the road.
Long-Term Impacts of Rollover Accidents
A serious injury can follow you long after the crash. It may bring:
- Lost wages and medical bills
- A disability that keeps you from work you used to do
- A lower quality of life
How to Determine Liability in a Rollover Collision
Louisiana law says a person whose fault causes damage to another must repair it (Civil Code Article 2315). A rollover collision attorney in Louisiana looks at every party who may have played a part.
Other Drivers
Another driver may have sideswiped you, cut you off, or forced you off the road. In a multi-vehicle crash, more than one driver may share the blame. If a big rig was involved, our truck accident lawyers can look into the trucking company’s role, too.
Vehicle and Tire Makers
Even a single-vehicle rollover can involve a defect. Louisiana’s Products Liability Act can make a maker pay.
The Act applies when an unreasonably dangerous product causes harm while used in a way the maker should expect (R.S. 9:2800.54). The law lists four ways a product can be unreasonably dangerous:
- How it was built or what it was made of
- Its design
- A missing or inadequate warning
- Not matching the maker’s express warranty
The injured person must prove these points. That is why the vehicle should be inspected before it is repaired or scrapped.
Public Entities and Road Defects
Claims against a public entity over a road problem come with extra rules:
- In most road-condition claims, you must show the entity knew or should have known about the defect, had a fair chance to fix it, and did not (R.S. 9:2800)
- After a lawsuit is filed, service on the public entity must be requested within 90 days, or the claim against it can be dismissed (R.S. 13:5107)

Damages You Could Be Entitled to After Your Rollover Car Accident
As your rollover injury attorney in Louisiana, we look at what the crash has cost you now and what it will cost later. Depending on your case, you may be able to recover:
- Current and future medical treatment
- Lost wages and benefits
- Reduced ability to earn in the future
- Vehicle repair or replacement
- Pain and suffering
- Mental anguish
- Loss of consortium for certain family members (Civil Code Article 2315)
Learn how pain and suffering is calculated in Louisiana.
Was the other driver drunk or impaired? You may be able to seek extra (exemplary) damages. The driver’s intoxication and wanton or reckless disregard for safety must have caused your injuries (Civil Code Article 2315.4).
If you lost a loved one, a wrongful death claim may be possible. Louisiana law sets who can file, in order: a spouse and children, then parents, then brothers and sisters, then grandparents (Civil Code Article 2315.2).
What to Do After a Rollover Crash in Louisiana
If you are able, the Louisiana Department of Insurance suggests these steps:
- Call the police right away, and call 911 if anyone is hurt
- Take photos and notes at the scene, if it is safe
- Notify your insurance company
- Get a copy of the police report, no matter who is at fault
You can request a Louisiana State Police crash report online once 15 working days have passed. Fatal crash reports are sold only in person at local Troop offices.
Then protect your claim. Get medical care, even if you feel fine. Talk with a lawyer before giving a recorded statement to the other driver’s insurer, and keep the vehicle until it can be inspected.

Causes of Rollover Accidents in Louisiana
The cause of a rollover plays a significant part in how we approach your claim. NTHSA has found that rollovers are closely tied to factors that may be outside your control, such as unsafe and reckless driving or poor road design. A rollover crash lawyer in Louisiana traces the chain of events back to the start, because the cause often points to who should pay.

Louisiana’s 51% Fault Rule
Louisiana gives a share of fault to everyone who caused or added to the harm. That includes people who are not part of the lawsuit (Civil Code Article 2323). Since January 1, 2026:
- If you are less than 51% at fault, your damages go down by your share
- If you are 51% or more at fault, you cannot recover damages
After a rollover, an insurer may claim you were speeding or jerked the wheel. A few percentage points can change what you receive.
Insurance That May Cover Your Rollover Crash
Each vehicle in Louisiana must carry at least these liability limits (R.S. 32:900):
- $15,000 for injury or death to one person in one crash
- $30,000 for injury or death to two or more people in one crash
- $25,000 for damage to other people’s property in one crash
Uninsured/underinsured motorist (UM) coverage can pay when the at-fault driver has no insurance or too little. Louisiana policies include UM unless a named insured rejected it or chose less coverage on a state form (R.S. 22:1295).
Say a driver ran you off the road, never touched your vehicle, and kept going. UM can still cover your injuries if that driver is unknown, uninsured, or underinsured. But you must prove it through an independent and disinterested witness (R.S. 22:1295).
Louisiana’s “No Pay, No Play” Law
Did you own or drive a vehicle without the insurance Louisiana requires? Then you cannot recover the first $100,000 of injury damages or the first $100,000 of property damage (R.S. 32:866). These amounts took effect August 1, 2025.
Exceptions include cases where the other driver fled, caused the crash on purpose, or was cited for impaired driving and later convicted or pleaded no contest. A passenger who does not own the uninsured vehicle can still bring a claim.
