Cases We Handle in Baton Rouge
Home »
Baton Rouge brings together interstate traffic, commercial freight, construction, industrial work, and Mississippi River commerce. From the I-10 and I-12 corridors to I-110, Airline Highway, College Drive, and streets throughout East Baton Rouge Parish, a serious accident can quickly leave you dealing with medical treatment, missed work, insurance questions, and unexpected expenses.
Our Baton Rouge personal injury lawyers help injured people understand their rights and what legal options may be available.
We represent people injured in car accidents, commercial truck crashes, 18-wheeler wrecks, and motorcycle accidents. Big or small, I handle them all™. Depending on the circumstances, we may review photographs, witness information, vehicle data, driver records, maintenance documents, medical records, and available insurance coverage.
Baton Rouge and the surrounding Capital Region are also closely connected to industrial and maritime work. The Port of Greater Baton Rouge is located at the head of deepwater navigation on the Mississippi River and provides access to ship, barge, truck, rail, and Gulf Intracoastal Waterway transportation. Its jurisdiction includes East Baton Rouge and Ascension Parishes.
We help people with workers' compensation claims and serious industrial and plant accident cases. For qualifying workers injured offshore, aboard vessels, or on navigable waters, our offshore and maritime injury lawyers can review whether the Jones Act, another federal maritime law, or Louisiana law may apply.

Courts Serving Baton Rouge and the Capital Region
If your injury claim requires a lawsuit, the appropriate court depends on where the accident occurred, where the parties are located, the type of claim involved, and Louisiana's jurisdiction and venue rules.
Baton Rouge is located in East Baton Rouge Parish, which is served by the 19th Judicial District Court. The courthouse is located at 300 North Boulevard in downtown Baton Rouge.
Baton Rouge City Court, located at 233 Saint Louis Street, also handles qualifying civil matters. Its Civil Division currently has jurisdiction over disputes valued at $35,000 or less, while its small claims division handles qualifying matters up to $5,000.
Some claims that fall within federal jurisdiction may be heard in the U.S. District Court for the Middle District of Louisiana, located at 777 Florida Street in Baton Rouge. The Middle District includes East Baton Rouge, Ascension, Livingston, West Baton Rouge, Iberville, Pointe Coupee, and several surrounding parishes.
Because our Baton Rouge office also serves Prairieville, claims connected to Ascension Parish may instead fall within the 23rd Judicial District Court, which has original jurisdiction over civil and criminal matters in Ascension, Assumption, and St. James Parishes.
Not every injury case becomes a lawsuit, and you do not need to determine the proper court before calling us. If litigation becomes necessary, we can evaluate the facts and determine which court may have jurisdiction.
What to Do After an Accident in Baton Rouge
Your health and safety should come first. Seek medical attention when needed and notify law enforcement when Louisiana law requires a crash to be reported.
If you can safely do so:
- Take photos or video of the vehicles, roadway, property damage, traffic controls, and visible injuries.
- Exchange contact and insurance information.
- Ask witnesses for their names and contact information.
- Keep medical records, bills, repair documents, and proof of time missed from work.
- Save letters, emails, texts, and other communications from insurance companies.
- Be cautious about signing a release or settlement agreement before understanding how it may affect your rights.
Louisiana law requires immediate notice to the appropriate law-enforcement agency when a motor vehicle crash results in an injury, death, or more than $500 in property damage.
If you were injured while working, notify your employer as soon as possible. Louisiana workers' compensation law generally requires notice within 30 days after the injury or death, although exceptions and other statutory provisions can affect that requirement.
If your family lost someone because of an accident, different legal rights and deadlines may apply. Our Baton Rouge wrongful death attorneys can review the circumstances with eligible family members.
When Can a Baton Rouge Injury Lawyer Help?
You may want to speak with us when an accident causes serious injuries, treatment is ongoing, responsibility is disputed, multiple people or businesses may be involved, or an insurance company questions coverage or damages.
We can investigate what happened, review available evidence, identify potentially responsible parties, examine insurance coverage, communicate with insurers, and explain what legal options may be available based on your situation.
Some Baton Rouge cases involve several possible sources of responsibility. A commercial truck accident may involve the driver, motor carrier, vehicle owner, maintenance company, cargo contractor, or more than one insurer. A construction or industrial accident can raise questions about employers, contractors, property owners, equipment manufacturers, or other businesses.
A workplace accident can also present different types of claims. Workers' compensation may provide benefits through an employer, while a separate claim against another legally responsible party may be possible in some circumstances.
You do not need to figure out those relationships before contacting us. We can review the facts and explain which issues may matter.

How Long Do I Have to File an Injury Claim in Louisiana?
Louisiana places deadlines on personal injury claims.
Civil Code article 3493.1 generally provides a two-year prescriptive period for delictual actions, beginning on the day the injury or damage is sustained. The provision became effective July 1, 2024.
Claims arising before that date and certain other types of cases may follow different rules or deadlines. The applicable period depends on the type and timing of the claim, so you should not assume every injury case gives you two years.
If you are unsure how much time you have, we can review the circumstances with you.
What If I Was Partly at Fault?
Being partly responsible for an accident does not necessarily answer whether you can recover damages.
For claims governed by Louisiana Civil Code article 2323 as amended effective January 1, 2026, a person whose negligence is 51% or greater generally cannot recover damages. When the injured person's negligence is below 51%, recoverable damages are generally reduced according to that percentage.
Other rules and exceptions to Louisiana’s modified comparative law can affect a particular claim. We look at the available evidence rather than relying only on another driver's account, an initial police report, or an insurance company's assessment of fault.
